I, the undersigned ("Rider"), understand and acknowledge that riding an electric bicycle, including the Aventon Aventure.2 models provided, involves inherent risks, dangers, and hazards. These risks include, but are not limited to, traffic conditions, weather, equipment failure, and my own negligence or the negligence of others. I voluntarily choose to rent and ride the e-bike and assume all risks of personal injury, property damage, or death.
2. Complete Release of Liability
I hereby completely and fully release, waive, and discharge the owner/renter from any and all claims, demands, or causes of action for any injury, damage, loss, or death that occurs during or as a result of my use of the e-bike. In short: I am riding at my own risk, and the owner is not liable for any injuries or accidents.
3. Equipment Condition and Responsibility
I accept the e-bike and all provided accessories (such as locks, helmets, and batteries) in their current "as-is" condition. I agree to:
- Return the e-bike and all accessories in the exact same condition I received them.
- Assume full financial responsibility for any damage to the e-bike, loss of the e-bike, or theft during the rental period. If I break it, I buy it or pay for the full cost of repairs.
- Cover any costs associated with damage I cause to third-party property or individuals while operating the e-bike.
4. Rider Declarations
By signing this document, I confirm that:
- I am at least 19 years of age.
- I am physically fit and capable of operating a heavy, fast electric bicycle.
- I will obey all local traffic laws and regulations.
- I will not operate the e-bike under the influence of drugs or alcohol.
5. Responsibility for Minors
If I allow a minor (anyone under the age of 19) to ride or use the e-bike during my rental period, I assume 100% responsibility for their safety and actions. I agree to fully indemnify and hold the owner harmless against any and all claims, lawsuits, or damages brought by or on behalf of the minor. I guarantee the minor will wear a helmet and be under my direct supervision at all times. In short: If a kid I let ride gets hurt or causes damage, it is entirely on me.
6. Governing Law
This agreement shall be governed by the laws of the State of Nebraska. Any legal disputes will be handled in the courts of Douglas County, Nebraska.
I HAVE READ THIS WAIVER OF LIABILITY, FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS BY SIGNING IT. I SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
